Terms and conditions of website (Required)

ARTICLE 1. Purpose

This terms and conditions is to stipulate basic regulations and procedures of using the online service (Hereafter referred to as “Service”) of Paradise Hotel website provided by Paradise Hotel Inc. (Hereafter referred to as “Company”).

ARTICLE 2. Effective Date and Change of Terms and Conditions

1. This terms and conditions becomes effective when it is announced by posts on the service menu and the company.
2. The company can change the contents of the terms and conditions, and the changed contents take effect after announced or informed through the same means mentioned above in the paragraph 1.
3. Member customers can stop using the service or terminate the contract if do not agree with the changed terms and conditions. Continued use of service after the change is deemed as agreed to the changed contents.

ARTICLE 3. Rules beside Terms and Conditions

If an unmentioned subject in the terms and conditions is ruled by The Telecommunications Basic Act, Telecommunications Business Act and other related law, it could be ruled accordance with the law.

ARTICLE 4. Definition of Terms

The terms used in this terms and conditions are defined as below.
1. Membership: This terms and conditions becomes effective when it is announced by posts on the service menu and the company.
2. ID: It is a combination of letters and numbers decided by the member and approved by the company for the identification of the member and the use of service.
3. Password: It is a combination of letters and numbers decided by the member to identify oneself with the given ID and to protect the password.
4. Termination: The expression of the company or a member to end the membership after opening the service.

ARTICLE 5. Establishment of Service Use Contract

The service use contract is established when the company approves the member application for the use of service.

ARTICLE 6. Application for the Use of Service

1. One has to fill out all the requested user information in the application form.
2. One must be aged 19 or above to use the service.
3. All the user information written in the application form is deemed as actual information. Those who did not use real names or actual information cannot be legally protected and will be disadvantaged in using the service.

ARTICLE 7. Approval of the Application

  • 1. The company approves the application for the use of service based on the article 6 with exceptions in paragraph no.2 and 3.
  • 2. The company can defer the approval until it addresses the following situation.
    • A. When the service related equipment capacity is not enough.
    • B. When there are technological difficulties.
    • C. When the company recognized the necessity.
  • 3. The company may not accept the application for the cases below.
    • A. When the applicant used other person’s identity.
    • B. When the submitted information is not true.
    • C. When the purpose of the application is to obstruct social order and stability or public morals.
    • D. When the application does not meet the required conditions by the company.

ARTICLE 8. Change of User Information

When the user information is changed, one must alter the information accordingly through online, and any problems rising from not correcting the information will be responsibilities of the user.

ARTICLE 9. Duties of Company

  • 1. The company cannot disclose or distribute the personal information acquired through the use of service to the third party without prior consent. However, following cases are exceptions.
    • A. When asked by a government institution in accordance with regulations of the laws including The Telecommunications Basic Act.
    • B. When needed for a crime investigation or asked by Korea Internet Safety Commission
    • C. When requested in accordance with the procedure set up by a related law.
  • 2. Within the range of paragraph 1, in relation to the business, the company can make and use the statistics on the personal information of the whole or certain members. Also, the company can send computer cookies through the service. In this case, the members can reject the reception of cookies or change the computer browser set up to receive warnings of incoming cookies.

ARTICLE 10. Duties of Members

  • 1. Members should not engage in the following acts when using the service.
    • A. Using other member’s ID
    • B. Copying, duplicating, changing and translating the information acquired through the service or using it for publication or broadcast, or providing it to the third party without prior consent of the company beside for the purpose of the use by a member.
    • C. Infringement of rights including the copy rights of the company and others.
    • D. Distributing information, sentences, figures that disturb public order and morals.
    • E. Using for the purpose of crime acts or deemed to be connected with a crime.
    • F. Acts that violate related law.
  • 2. Members must abide by the related law, regulations of the terms and conditions and service guidelines.
  • 3. Member must follow the announcement noticed on the service board or notified separately by the company.
  • 4. Members cannot seek profits using the service without prior consent of the company.

ARTICLE 11. Responsibilities of Members in Managing Member ID and Password

  • Members are responsible for the management of their ID and password.
  • All the consequences resulted from careless management and wrongful use of membership ID and password fall under the responsibility of the members.
  • Members must inform the company any cases of illegal use of ID or security violations.

ARTICLE 12. Provided Service

The company can provide various information that is deemed necessary through emails or letters during the service period, and if a member wishes to deny the service, he/she can decide to opt out in the member application and membership information modification menu.

ARTICLE 13. Business with Advertiser

The company is not liable for any loss or damage resulting from participating, communicating or conducting businesses on the promotion activities that are posted on the service or advertiser’s other promotions through this service.

ARTICLE 14. Posts of Members

The company bears no responsibility for any contents posted, published or delivered through various means including emails by members. The company can delete the posts without prior notification for the cases below.

  • 1. Contents that slander other members, infringe privacy and taint one’s reputation through mudslinging.
  • 2. When there are disruptions or concerns for disturbances in the stable operation of the service.
  • 3. When recognized as related to crime acts.
  • 4. Contents that violate rights including the copy rights of the company and others.
  • 5. When the posting period set by the company has been expired
  • 6. When determined as violations of other related law.

ARTICLE 15. Rights and Responsibilities to the Posts

The member who uploaded the post has all the rights and responsibilities to the post including the copyright.

ARTICLE 16. Responsibilities of Service Use

Members can not engage in business activities using the service that sell illegal products, and are especially banned from hacking, putting up advertisement for money, commercial acts through pornographic sites and illegal distribution of commercial S/W. The company is not responsible for any losses or the results of business activities occurred by breaking the regulation, or other legal consequences including imprisonment by related institutions.

ARTICLE 17. Service Suspension

The company can limit or suspend the whole or parts of the service in the times of war, natural disasters and national emergency or when there are possibilities of those events, and also when a key telecommunications service provider suspends its service based on Telecommunications Business Act. Under the regulation in paragraph 1, the company must inform the members the cause and the period of the suspension when the service use has been suspended or stopped.

ARTICLE 18. Termination of Contract and Restriction of Use

1. When a member wishes to terminate the use contract, one must request to the company by him/herself.
2. The company can terminate the contract or restrict or suspend the use of service by setting the use period without prior notice under the following cases.

  • A. Illegal use of other member’s ID and password.
  • B. Disruptions on the service operation.
  • C. Distribution of contents on purpose that hurt public order and morals.
  • D. Planning or executing the use of service for the purpose of hindering the national interest or social benefits.
  • E. Engage in the acts that bring disadvantage or disgrace on others through diverse means of posting, publishing or sending via emails the contents that infringe other’s copy rights
  • F. Constantly sending unsolicited pornographic, vulgar, threatening contents or advertisement and emails.
  • G. Distributing computer virus programs that cause malfunction of telecommunication equipment or information destruction
  • H. Violating the copy rights of the company and others.
  • I. When there are requests for correction from outside organizations including Korea Internet Safety Commission, and when an authoritative interpretation is asked from National Election Commission in relation to illegal campaigning.
  • J. Illegal use of other’s personal information, ID and password
  • K. Duplication, distribution or commercial use of the information acquired by using the company’s service information without the company’s prior consent
  • L. Violating telecommunication related law.
  • M. Breaking related law or regulations including this terms and conditions set up by the company

ARTICLE 19. Compensation for Damage

In relation to the service use, the company bears no responsibilities for any damages occurred to the members during the period of no service charge.

ARTICLE 20. Liability Exemption

  • 1. In cases when the company is in an unmanageable situation to provide the service due to natural disasters or events that are beyond control, the company has the exemption from liability.
  • 2. The company is free from liability if a member is at fault for the service error.
  • 3. The company is not liable for a member’s not attained expected benefits from service provision of the company or losses caused from using, adopting or rejecting service contents.
  • 4. The company is not responsible for the posted information and documents by members and their accuracy and reliability. The members take responsibilities for any losses occurred from posting or sending contents using the service, and also for the disadvantage in relation to the adoption and rejection of information and other service use.

Paradian Reward Terms and Conditions (Required)

Article 1 Purpose

The purpose of these Terms and Conditions is to provide for any and all matters necessary for Paradise Hotel Busan(hereinafter referred to as the ;Hotel;) to manage Membership requirements, service utilization, and rights of Members for Paradian Reward(hereinafter referred to as the ;Membership;) Members.

Article 2 Membership Application and Membership Card Issuance

  1. 1) All the guests ; including foreigners - staying at the Hotel may participate in the Membership program for free. However, minors are not allowed to participate in this Membership.
  2. 2) To become a Member you must submit a Membership Application, consent to Privacy Policy, and have the Membership Card issued.
  3. 3) In order to replace a lost membership card, please visit the front desk of the main building of the Hotel so that your ID should be verified before issuing the replacement card.
  4. 4) Existing Members of the Hotel (Fitness, Platinum) may also sign up. However, Membership is not available to organizations or entities such as travel agencies and corporate hotel booking agents.
  5. 5) Members shall comply with Terms and Conditions and the instructions of operation manual as determined. Members who input false information when applying for the Membership may be restricted to ask for legal protection and to use service of the Hotel.
  6. 6) Point levels are based on the Points you;ve earned.

Article 3 Membership Termination and Loss of Qualification

  1. 1) A Member may cancel the Membership in writing, by email or other means. Such termination request will result in deletion of the Membership account and a loss of all points.
  2. 2) Hotel reserves the right, at its sole discretion, to exclude a member from membership program if:
    1. a) The submitted information is untrue,
    2. b) Points have been earned or redeemed illegally according to these terms and conditions,
    3. c) A Member violated a duty according to these Terms and Conditions,
    4. d) Normal business operation of the Hotel has been interrupted,
    5. e) A Member passed away
  3. 3) If a Membership is terminated as defined in Paragraph 1 of Article 3 of the Terms, all unredeemed points up to the day of termination request will be forfeited automatically.
  4. 4) If a Member is no longer qualified for Membership as defined in Paragraph 2 of Article 3, the unredeemed points earned up to the day of loss of qualification will be forfeited automatically.

Article 4 Guidelines for Earning and Redeeming Points

  1. 1) Guide to Earning Points
    1. a) In principle, Points may be earned upon presentation of valid Membership Card.
    2. b) Points may be redeemed at a point of sale as the method of payment upon earning. (However, points cannot be redeemed and earned at the same time at the same place of business.)
    3. c) Any purchases before signing up for Membership are not point-eligible.
    4. d) You can earn Points on eligible hotel purchases including goods and services as follows. (VAT excluded):
      1. ① Hotel Stays
        1. A. Ruby/Aquamarine Tier : Earn 2% on purchases
        2. B. Sapphire/Diamond Tier : Earn 3% on purchases
        3. C. Bookings made through travel agencies or corporate rate are not point eligible.
        4. D. Bookings made through special contract agencies award 1% on purchased night regardless of your Membership tier.
        5. E. Bookings made through OTAs are point eligible excluding OTA commissions and VAT.
      2. ② Hotel Dining and Beverages
        1. A. Ruby Tier : Earn 1% on purchases
        2. B. Aquamarine/Sapphire/Diamond Tier : Earn 2% on purchases
      3. ③ Earn 1% on purchases including Minibar items
      4. ④ Non-point-eligible items
        1. - Gift certificate purchases and Annual Membership fee for Platinum/Classic/Fitness
        2. - Meeting room rentals, Ball rooms/ Business center/Valet parking/purchases at leased properties
        3. - Miscellaneous charges during stays such as extra rate for the number of rooms exceeding more than 5 rooms per day, in-room phone calls etc.
        4. - Tuition fee, equipment rental, Screen golf fee
    5. e) Points shall be earned on purchases for the Members; own use.
    6. f) Points cannot be earned separately or combined.(Only one Member can earn points on one invoice.)
    7. g) If you pay with points for your stay, whole or in part, no points will be awarded for the amount paid with points.
    8. h) If an existing Member(Fitness, Platinum) signed up for Paradian Membership, duplicate discounts are not applicable. Higher discount rate will be applied, and points will be earned after deducting the discounted amount.
    9. i) A Member can earn points on up to 5 rooms per day, as long as he or she is an occupant of one of them. The name of the Member must be on each of the room;s reservation and he or she must be the one paying for all of the rooms on a single invoice.
    10. j) Points can be earned on the day at the Hotel. If you wish to earn retroactive points, correct, and verify the modification, you may do so by contacting Hotel Mileage Center within 1 month from the date of earning.
    11. k) In case of special promotion, there may be points-earning restrictions.
  2. 2) Guide to Redeeming Points
    1. a) In principle, points may be redeemed only by the Member and upon presentation of the valid Membership Card.
    2. b) Points can be redeemed against shopping and dining inside the Hotel and at some of the leased affiliates and shall not be used in any other places.
    3. c) A Member may begin to redeem points in increments of 1,000 after earning up to 5,000 points.
    4. d) Point is worth 1KRW per point. Points cannot be redeemed separately or combined.(not allowed to redeem two Membership points on a single invoice)
    5. e) Member points are not transferrable and cannot be used for loan or collateral purposes.
    6. f) ;Pay with point; is available on top of purchase discounts on goods and services. However, an existing Hotel Member (Fitness, Platinum) signed up, duplicate discounts are not available. Instead, the highest discount rate will be applied.
    7. g) Points are valid for 24 months from the month they;re earned. Once the validity period of 24 months has expired, the points will be removed based on first-in, first-out (FIFO) principles.
    8. h) If there are any changes that need to be made in terms of redeeming points, a Member shall make adjustments of points balances and verify the status via Hotel Mileage Center within 10 days from the date of redemption.
    9. i) A Member can redeem the points for the reward choices stated in the Terms and Conditions. However, the points shall not be redeemable for cash.
    10. j) A Member, regardless of Point Level, may pay with points to use sauna (including Cimer). Points will be deducted from the Member;s account.

    1. 1) If you apply to redeem the benefits based on the above guidelines, vouchers (gift certificates) will be issued in principle.
    2. 2) In order to redeem vouchers, please call our Mileage Center on 051-749-2200 and you may be required to verify identification. Voucher will be sent within 7 days from the date of application.
    3. 3) Vouchers issued upon request by a Member are neither cashable nor reversible. These vouchers are not for sale.
    4. 4) In principle, all vouchers issued upon request will be sent by post or shall be picked up by the Member. If a Member wishes to pick up the voucher personally, you may be required to show identification along with the Membership Card at the Front Desk of the Main Building of the Hotel.
    5. 5) Blackout dates for all the vouchers issued upon request are peak summer travel days and year-end holiday season. Please refer to the instruction on the voucher regarding Blackout dates detail and terms of use.
    6. 6) In order to redeem vouchers, advance reservations are required and the physical vouchers must be presented to be utilized.
    7. 7) Vouchers issued upon request are valid for 6 months from date of issuance and cannot be extended.
    8. 8) Vouchers issued upon request will not be replaced if lost or stolen, stolen or destroyed.

Article 5 Point Tiers and Benefits

  1. 1. Point tiers are determined and renewed at the end of 12-month term from the month of sign-up. Once your Membership Tier is renewed, it will be valid for 1 year from the date of renewal.
  2. 2. Membership benefits are valid only during the Membership Term and unredeemed rewards shall automatically expire and cannot be reissued or extended.
  3. 3. Benefits are embedded in the Membership card, please present your Membership Card for use. (Member;s own use only)

      1. a. Mini-bars, parties, Fitness Club restaurants, Cimer Aqua Bar, Room services, seasonal summer events(Garden operations), Special promos
      2. b. Deli Shop : imported goods and designated items, confectionery and bakery events

Article 6 Membership Card Use and Control

  1. 1) A valid Membership Card shall be presented for use.
  2. 2) You may be required to verify identification and shall comply with the request from the Hotel in order to have access to regular services.
  3. 3) Membership Card can only be used by the Member personally and shall not be loaned or lent to others. It shall not be transferred or provided as collateral.
  4. 4) Members shall be responsible for managing the Membership Card. If there is any incident involving damage, loss, or theft of the Membership Card due to intention of negligence of the Member, please contact the Hotel Mileage Center immediately.
  5. 5) Hotel will not assume any responsibility for any damages or compensation resulting from any violation of the Terms and Conditions relating to using the Membership Card.
  6. 6) A Member shall notify the Hotel if there are any changes including address or any other information, and the Hotel shall not be responsible for any inconvenience caused by failure to notify the information.

Article 7 Member rights

  1. 1) Points balance will be stated at the bottom of the receipt upon payment, and you may verify the detail on our website or with Hotel Mileage Center over the phone.
  2. 2) Members reserve the right to inquire the Hotel of different benefits and points status. Hotel may notify Members of any changes on the program detail and information by appropriate means. In case of notification by post, Hotel will not be responsible for any inconvenience caused by loss or delay.

Article 8 Revision of the Terms and Conditions of the Membership

  1. 1) In order to provide seamless operation, the Hotel reserves the right to amend the Terms and Conditions, which is applicable to all Members.
  2. 2) If there is any changes or modifications to the Terms and Conditions of the Membership Service due to Hotel;s internal circumstances, Hotel reserves the right to notify the Members of the same by email or on the website and have amendment take effect in 15 days.

Article 9 Suspension of Membership service

  1. 1) Hotel reserves the right to suspend the Membership service for seamless operation.
  2. 2) Hotel provides services until the end date of service program determined at its own discretion. If the Hotel suspends service program due to its circumstances, Hotel may terminate the Membership service by giving 6 months; notice to the Members by email or with notification on the website.
  3. 3) Once the service is terminated, Membership benefits will no longer be available. Points shall be redeemed by a designated date set by the Hotel. Otherwise, the remaining points will expire automatically.

  3. 3) In principle, personal information of the Members will be destroyed once the purpose of the use of collection and use is achieved. However, if needed, personal information is retained based on the relevant ground.

  5. 5) In principle, Hotel handles and manages privacy data. However, part of all of this may be outsourced to a designated third party.

Article 11 Liability for violation of any provision of these terms

  1. 1. Members who violate the rules defined in these Terms and Conditions will be liable for all resultant expenses and shall compensate the victim for any damages.

Article 12 Interpretation of the Terms and Governing Law

  1. 1. Membership programs is designed to provide rewards and benefits to the customers. Taking into account the fact that points are provided for free of charge, Members shall agree that the Hotel;s circumstances will be considered in the interpretation and application of the Terms and Conditions.
  2. 2. Any disputes relating to these Terms and Conditions will be resolved by the jurisdiction designated by the Hotel.

Amendments to the Paradian Reward Terms and Conditions

Agreement of Collection and Usage of Personal Information (Required)

Paradise Hotel Busan appreciates your personal information. In order to provide service, Hotel would like to obtain your consent in accordance with Article 15 and 22 of Personal Information Protection Act.

Agreement of Collection and Usage of Personal Information

  • 1. Purpose of collection and usage: identification, provision of services and information, handling complaints and inquiries
  • 2. Items to be collected
    • Required fields: ID, PIN/password, name, gender, DOB, mobile number, nationality, email address
  • 3. Retention period and Destruction
    • - To be removed immediately upon cancellation of the Membership
    • - Reservation detail: According to Commercial Act and Act on Consumer Protection in Electronic Commerce, it is retained for 5 years. (However, records of cancellation will be retained for 6 months.)
  • 4. You have the right to refuse to consent to this collection and use of personal information, but such refusal will place restrictions on membership enrollment.

  • 4. You have the right to refuse to consent to this collection and use of personal information. However, you may sign up as a Member without any restrictions even if you refuse consent. 

Consent to Provision of personal information to third parties (optional)

Personal information will be provided to third parties upon prior consent in order to share mileage points.
Hotel provides personal information in order to deliver improved service to customers.

Recipient : Paradise City, Sundari Spa
Purpose of using the personal information : To share reward points

Disclosed personal information : name, phone number, reward points
Retention period: upon cancellation of Membership (However, transactions shall be retained for 5 years.)

 

You have the right to refuse consent to provide Personal Information to third parties in order to share mileage points.

If you refuse consent, access to service may be restricted.

Consent to the use of personal information for marketing purposes (optional)

We will utilize your personal information in marketing activities for affiliated events promotion of services, customer satisfaction surveys, and secured communication channels. If you do not consent, you will not be informed of promotion including discounts, service guide, announcement etc.
